Consent Management Guide
This guide helps business customers collect and maintain valid TCPA consent before using OrifoneAI for outbound AI calling.
What counts as valid TCPA consent
Prior express written consent (PEWC) is the standard you should plan around.
For outbound AI calling, you generally need prior express written consent from each recipient where required by TCPA and related FCC rules. Consent must be clear, affirmative, and tied to the purposes of your outreach.
You should store the exact disclosure that was shown to the recipient and the date/time consent was given.
Acceptable consent collection methods
Use clear, non-prechecked opt-in flows.
- Web forms with clear disclosure before consent is recorded.
- Signed agreements that include the required disclosure language.
- Opt-in checkboxes (NOT pre-checked) with a link or text describing what the recipient agreed to.

How to store consent records
Store enough information to prove what was shown and when.
- Date and time consent was collected
- IP address (or other identifier used for consent capture)
- Exact disclosure text shown to the recipient
- Where/how consent was collected (form name, checkbox label, agreement ID)
- Recipient phone number(s) that consent applies to
How to honor opt-outs
Treat opt-out requests as immediate campaign suppression.
Process opt-outs within 10 business days as referenced in FTC rules and related guidance. In practice, you should suppress the recipient from future outreach as soon as an opt-out is received and confirm suppression in your systems.
Make sure your scripts and AI agent instructions route opt-out requests correctly.
State-specific notes
Some states impose stricter consent and disclosure requirements.
- California: Consider CCPA-related operational requirements and any California-specific telemarketing rules that apply to your campaign.
- Florida: Review stricter telemarketing and disclosure expectations for outbound outreach.
- Texas: Some contexts require additional documentation and clearer consent wording.
When in doubt, apply the strictest applicable rules for each recipient's location.
